  1. Legal information and acceptance

The present provisions regulate the use of the Internet portal service (hereinafter, the ‘Portal’) that Marbella Music School makes available to Internet users.

Access to the website is free of charge except for the cost of connection through the telecommunications network supplied by the access provider contracted by users. Certain services are exclusive to our clients and access to them is restricted.

The use of the Portal confers the condition of Portal user (hereinafter, the ‘User’) and implies acceptance of all the conditions included in this Legal Notice. The provision of the Portal service is limited to the time at which the User is connected to the Portal or to any of the services provided through it. Therefore, the User must read this Legal Notice carefully each time he/she intends to use the Portal, as the Portal and its conditions of use set out in this Legal Notice may undergo modifications.

Some Portal services accessible to Internet users or exclusive to customers of Marbella Music School may be subject to special conditions, regulations and instructions which, where appropriate, replace, supplement and / or modify this Legal Notice and must be accepted by the user before starting the corresponding service.

  1. Intellectual and industrial property

All contents of the Portal, understood to include but not limited to text, photographs, graphics, images, icons, technology, software, links and other audiovisual or audio content, as well as graphic design and source codes (hereinafter, the ‘Content’), are the intellectual property of Marbella Music School or third parties, without being transferred to the User any of the exploitation rights recognized by current legislation on intellectual property on them, except those that are strictly necessary for the use of the Portal.

The trademarks, trade names or logos are owned by Marbella Music School or third parties, without it being understood that access to the Portal attributes any rights over such trademarks, trade names and / or logos.

All information received on the website, such as comments, suggestions or ideas, will be considered transferred to Marbella Music School free of charge. Information that can NOT be treated in this way should not be sent.

All products and services on these pages that are NOT the property of Marbella Music School are trademarks of their respective owners and are recognised as such by our company. They only appear on the Marbella Music School website for promotional and information gathering purposes. These owners may request modification or deletion of the information belonging to them.

  1. Terms of use of the portal

3.1 General

The User undertakes to make proper use of the Portal in accordance with the Law and this Legal Notice. The User shall be liable to Marbella Music School or third parties for any damages that may be caused as a result of a breach of this obligation.

It is expressly forbidden to use the Portal for purposes harmful to property or interests of Marbella Music School or third parties or in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or products and applications (software) of Marbella Music School or third parties.

3.2 Contents

The User undertakes to use the Contents in accordance with the Law and this Legal Notice, as well as with any other conditions, regulations and instructions that may be applicable in accordance with the provisions of clause 1.

By way of example only, the User, in accordance with current legislation, must abstain from:

Reproduce, copy, distribute, make available, publicly communicate, transform or modify the Content except as permitted by law or expressly consented to by Marbella Music School. or by whoever holds the ownership of the exploitation rights where appropriate.

Reproduce or copy for private use the Content that may be considered as Software or Database in accordance with current legislation on intellectual property, as well as its public communication or making it available to third parties when these acts necessarily imply the reproduction by the User or a third party.

Extract and / or reuse all or a substantial part of the contents of the Portal and the databases that Marbella Music School made available to users.

3.3 Data collection forms

Without prejudice to the provisions of clause 5 of this Legal Notice, as well as the privacy policies accessible from the Portal and that may be applicable at any time, the use of certain services or requests addressed to Marbella Music School are conditional upon the prior completion of the corresponding User registration.

All information provided by the User through the Portal forms for the above purposes or any other must be truthful. To this end, the User guarantees the authenticity of all data provided and will keep the information provided to Marbella Music School perfectly updated so that it responds, at all times, to the real situation of the User. In any case the user will be solely responsible for any false or inaccurate statements made and the damages caused to Marbella Music School or third parties for the information provided.

To ensure the quality of our website, we reserve the right to reject any application for registration or to suspend or cancel a previously accepted registration if we believe that it does not meet these requirements or any other law or regulation. If this happens, we will try to give reasons for our decision, but we cannot undertake to do so in all cases.

3.4 Introduction of links to the Portal

Internet users who wish to introduce links from their own web pages to the Portal must comply with the conditions detailed below, without ignorance of these conditions avoiding the responsibilities derived from the Law:

The link will only link to the home page or main page of the Portal but may not reproduce it in any way (online links, copy of texts, graphics, etc).

It shall be prohibited in any case, in accordance with the applicable legislation in force at any given time, to establish frames of any kind that surround the Portal or allow the Contents to be viewed through Internet addresses other than those of the Portal and, in any case, when they are displayed together with contents outside the Portal in such a way that: (I) produces, or may produce, error, confusion or deception in users about the true origin of the service or Content; (II) involves an act of unfair comparison or imitation; (III) serves to exploit the reputation of the brand and prestige of Marbella Music School; or (IV) in any other way is prohibited by current legislation.

No false, inaccurate or incorrect statements about Marbella Music School, its partners, employees, customers or about the quality of the services it provides shall be made from the page that introduces the link.

Under no circumstances will it be expressed on the page where the link is located that Marbella Music School has given its consent to the insertion of the link or that it otherwise sponsors, collaborates, verifies or supervises the services of the sender.

It is forbidden to use any word mark, graphic or mixed or any other distinctive sign of Marbella Music School within the page of the sender except as permitted by law or expressly authorized by Marbella Music School and provided that, in these cases, a direct link to the Portal in the manner set out in this clause is allowed.

The page that establishes the link must comply faithfully with the law and may not under any circumstances provide or link to its own or third party content that: (I) is unlawful, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.. ); (II) induce or may induce the user the false conception that Marbella Music School subscribes, endorses, adheres to or in any way supports the ideas, statements or expressions, legal or illegal, of the sender; (III) are inappropriate or irrelevant to the activity of Marbella Music School in view of the place, content and subject matter of the sender’s website.

  1. Exclusion of liability

4.1 From the Information

Access to the Portal does not imply any obligation on the part of Marbella Music School to verify the truthfulness, accuracy, adequacy, suitability, completeness and timeliness of the information provided through it. The contents of this page are of a general nature and do not constitute, in any way, the provision of a legal advice service or of any kind, so that such information is insufficient for making personal or business decisions by the user.

Marbella Music School is not responsible for decisions taken based on the information provided on the Portal or for any damages caused to the User or third parties as a result of actions that are based solely on information obtained from the Portal.

4.2 Quality of service

Access to the Portal does not imply any obligation on the part of Marbella Music School to control the absence of viruses, worms or any other harmful computer element. It is up to the user, in any case, the availability of adequate tools for the detection and disinfection of harmful computer programs.

Marbella Music School is not responsible for any damage caused to the computer equipment of users or third parties during the provision of the Portal service.

4.3 Availability of the Service

Access to the Portal requires services and supplies from third parties, including transport through telecommunications networks whose reliability, quality, continuity and operation does not correspond to Marbella Music School Therefore, the services provided through the Portal may be suspended, cancelled or become inaccessible, prior to or simultaneously with the provision of the Portal service.

Marbella Music School is not responsible for damages of any kind caused to the user that are caused by failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of the Portal service during the provision of the same or prior to it.

4.4 Content and services linked through the Portal

The service of access to the Portal includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In these cases, Marbella Music School acts as an intermediary service provider in accordance with Article 17 of Law 34/2002 of 12 July, Services of the Information Society and Electronic Commerce (LSSI) and will only be responsible for the content and services provided on the Linked Sites to the extent that it has actual knowledge of the illegality and has not disabled the link with due diligence. In the event that the User considers that there is a Linked Site with illegal or inappropriate content may notify Marbella Music School in accordance with the procedure and the effects established in clause 6, without in any case this communication entails the obligation to remove the corresponding link.

Under no circumstances should the existence of Linked Sites presuppose the existence of agreements with those responsible or owners thereof, nor the recommendation, promotion or identification of Marbella Music School with the statements, content or services provided.

Marbella Music School does not know the contents and services of the Linked Sites and therefore is not responsible for the damages caused by the unlawfulness, quality, unavailability, error and uselessness of the contents and/or services of the Linked Sites or for any other damage that is not directly attributable to Marbella Music School.

  1. Protection of personal data

The data collected through the data collection forms of the Portal will be incorporated into an automated personal data file for which Marbella Music School is responsible. This entity will treat the data confidentially and for the purpose stated in the files registered with the Spanish Data Protection Agency for this purpose. Likewise, Marbella Music School will cancel, delete and/or block the data when they are inaccurate, incomplete or no longer necessary or relevant for their purpose, in accordance with the provisions of the legislation on data protection.

The User may revoke the consent given and exercise the rights of access, rectification, cancellation and opposition by contacting the address indicated in clause 1, for this purpose must indicate name, surname, plus a photocopy of your ID card.

Marbella Music School adopts the security levels required by the Security Measures Regulation approved by Royal Decree 1720/2007, of December 21, which implements Organic Law 15/1999, of December 13, on the Protection of Personal Data. Marbella Music School may use cookies during the provision of the Portal’s services. Description of the facts revealing the unlawful or inappropriate nature of the Linked Site.

In cases of rights violations, such as intellectual and industrial property rights, the personal details of the rights holder if different from the reporter.

Additionally, the reporter must provide:

Proof of authorization of the rights holder, and where applicable, proof of representation to act on behalf of the rights holder when they are not the reporter.

An express statement confirming the accuracy of the information contained in the complaint.

The receipt of the communication by Marbella Music School, as outlined in this clause, will not imply, as stated in the LSSI (Law on Information Society Services), effective knowledge of the activities and/or content mentioned by the reporter.

All notifications and communications made by the parties will be valid in accordance with the means permitted by law. Those related to this Portal will be considered effective, for all purposes, if made through the Portal itself.

Marbella Music School reserves the right to make any modifications it deems appropriate to its website without prior notice, including the ability to change, remove, or add both the content and services provided, as well as the way they are presented.

Furthermore, these terms and conditions may change at any time. The modifications will take effect from the moment of their publication..

  1. Legislation

This Legal Notice is governed in every aspect by Spanish law. For any dispute that may arise related to the website or the activities conducted on it, the competent courts will be those of Marbella, with the user expressly waiving any other jurisdiction that may apply.
